Johnson vs. Borgata
Date of Accident: 1/31/05
Trial commencing: 9/22/08
$854,013.45 was the recovery a jury awarded Mr. Johnson.. The Defendant had
initially offered $9,000.00 to settle the claim. Mr. Johnson was caused to
slip and fall on a slippery floor. The Defendant had blamed him for the fall
sent him to a defense exam but at the time of Trial did not call the defense
doctor or produce his report.
Roberts vs. St. Louis
Date of Accident: 9/9/04
1,015,000.00 was the amount given to Mr. Roberts at a binding arbitration
held on 8/5/08. Mr. Roberts was rear-ended and underwent back surgery and
was able to return to full-time employment at his regular job. Defendant's
position was that Mr. Roberts had a pre-existing condition not related to
the accident.
Perez vs. Union Dry Dock
Date of Accident: 8/26/02
Mr. Perez was awarded the amount of $950,000.00 when he slipped and fell at
work on the ship that was being sandblasted. The Defendants blamed Mr. Perez
for the fall indicating he was not watching where he was going and alleged
under the influence of cocaine. Mr. Perez underwent neck surgery and alleged
he was disabled as a result of same.
Beshay vs. USA
Date of Accident: 9/27/04
Mr. Beshay was awarded $800,000.00 after he was hit by a postal truck. The
post office blamed Mr. Beshay for the accident alleged he had degenerative
changes and was able to work as a maintenance man. Mr. Beshay indicated he
was not at fault and was disabled.
Vasquez vs. Eduardo Pizzaro
Date of Accident: 2/27/03
Trial commencing: 4/29/08
Mr. Vasquez was awarded $643,617.00 after being involved in a car accident
with Defendant Pizzaro. The defendant blamed Mr. Vaquez for the accident and
indicated all the injuries were from a pre-existing condition in aprior accident
which he went to Trial and lost. They produced prior dep transcripts and MRI's
of his prior case with other counsel. Plaintiff's position was while he had
injuries from a prior accident his inability to work and need for surgical
intervention was as a result of this accident. In spite of the fact, that
he testified from the past he needed surgery in his prior accident which he
chose not to do until this accident.
Gallimore vs. Zaczek
Date of Accident: 11/1/97
Mr. Gallimore was involved in a car accident where he alleged injuries and
surgical intervention. The Defendant blamed him for the accident and submitted
prior medical records alleging prior injuries. Case went to arbiration with
prior counsel with an award of $7,500.00. Mr. Gallimore was resolved for $490,000.00.
Cregan vs. Pablo Veloso
Date of Accident: 11/11/03
Ms. Cregan was awarded $350,000.00 for neck and back injuries. Ms. Cregan
was hit by defendant who attempted to flee.
Robinson vs. Cullen
Date of Accident: 1/31/05
$500,000.00 was awarded to the Plaintiff after an automobile accident. Ms.
Robinson alleged neck injuries when the car she was in was rear-ended.
Esteves-Torres vs. Paulino-Ruiz
Date of Accident: 3/27/02
Mr. Esteves-Torres was awarded $500,000.00 after he was sideswiped by a truck.
Mr. Esteves-Torres alleged back and neck injuries
Keys vs. Ostrowski
Date of Accident: 8/23/99
Ms. Keys had a knee injury as a result of the defendant hitting her vehicle.
Defendants position was her knee injuries was as a result of her larger size.
She was awarded $1.2 million dollars.
Trinidad vs. Central Mutual Insurance Company
Date of Accident: 1/27/03
Mr. Trinidad was awarded $710,000.00 as a result of a motor vehicle accident
when Mr. Trinidasd was sitting on a milk crate and a cargo van was involved
in an accident. Defendants position was that Mr. Trinidad's injuries was compounded
by him not being properly secured in the vehicle.
Santiago vs. Waltrous
Date of Accident: 1/22/98
$1,127,446.00 was awarded to Mr. Santiago. Mr. Santiago was a corrections
officer supervising inmates cleaning a side of the road when the defendant
rear-ended the vehicle he was in. Defendants position was there was no damage
to the bus Santiago was driving and no feesable way he was injured. He also
received a police pension and full social security benefits.
Gonzalez, Sr. vs. Whitney
Date of Accident: 2003
Mr. Gonzalez was injured and had a prior accident who spoke broken english.
He was offered $3,000.00 prior to Trial. Jury trial in front of Judge Epstein
by Karim Arzadi resulted in a jury award of 1.2 million dollars.
Gonzalez vs. Repace
Date of Accident: 1/22/98
$790,000.00 was awarded to Mr. Gonzalez. He was a Perth Amboy police officer
involved in a motor vehicle accident with defendant Repace who was delivering
parts for Volkswagen. Mr. Gonzalez injured his knee and back and was unable
to proceed with his work duties. He also received a police pension and full
social security benefits.
